All content created by BrightShine Media is licensed to the client for use in their own marketing and promotional materials.

This includes:

• Social media platforms
• Business websites
• Organic (Non-paid advertising)

Paid advertising usage (such as social media ads or sponsored campaigns) is not included by default and requires an additional licence.

The client may not:

• Resell or licence the content to third parties 
• Provide the content to other businesses for their use
• Heavily alter or edit the content without permission

BrightShine Media retains the right to use all content for portfolio, promotional, and marketing purposes unless otherwise agreed in writing.

Extended usage rights, including paid advertising and third party use, can be arranged upon request.

1. Booking & Payment

• A booking is confirmed only upon receipt of a deposit.
• The remaining balance must be paid before delivery of final content.
• Our pricing may change. Any quotes provided are valid for a limited time (7 days), and once booking is confirmed, the agreed price is fixed and will not be altered unless additional extras are wanted at the time of delivery.

2. Cancelations & Rescheduling

• Deposits are non refundable
• Rescheduling permitted with at least 7 days notice (subject to availability), deposit may be transferred to a new date.
• Bookings cancelled without rescheduling will result in the deposit being forfeited.
• Cancellations within 7 days will result in deposit being forfeited.
• Late cancellations or no shows may result in additional charges, up to the full booking fee.

3. Delivery

• Delivery timelines are estimates and may vary.
• Final deliverables are provided in agreed formats.
• Raw files are not included unless explicitly stated.

4. Creative Control

• BrightShine Media retains full creative control to ensure a consistent, high quality result aligned with our style. That said, we always encourage clients to share ideas, references, or specific preferences before the shoot so we can tailor the outcome to your vision. 
• Clients acknowledge that work will be delivered consistent with the company's portfolio style.

5. Copyright & Intellectual Property 

Ownership

• All photographs and videos remain the intellectual property of BrightShine Media under Australian copyright law.

Personal Use Licence

• Clients are granted a non exclusive, non transferable license for personal use (e.g., social media, personal prints.)

Commercial Use Licence 

• Commercial use (advertising, marketing, branding, resale, etc.) requires a seperate license agreement.
• Licensing terms (duration, region, platform) will be specified in writing.

Restrictions 

Clients may not:

• Sell or redistribute the content
• Heavily edit, alter, or apply filters without permission
• Claim authorship of the work

6. Portfolio & Marketing Use 

• BrightShine Media reserves the right to use all content for portfolio, website, social media, and promotional purposes unless otherwise agreed in writing. 

7. Client Responsibilities

• Clients must ensure timely arrival and cooperation during shoots.
• Necessary permissions (location, permits, model releases) must be obtained unless agreed otherwise agreed.

8. Liability

• BrightShine Media is not liable for circumstances beyond control, including weather, equipment failure, or unforeseen disruptions.
• In the unlikely event of total failure, liability is limited to a refund of payments made.

9. Studio Use

• Studio hire is subject to minimum booking times.
• Clients are responsible for any damages during their sessions. 

10. Governing Law

• These terms are governed by the laws of Australia.

By making a booking with BrightShine Media, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

At BrightShine Media we may collect personal information such as your name, email address, phone number, and any details you submit through our contact forms.

Your information is used to respond to inquires, provide services, and improve the functionality of our website.

• Website hosting provider
